These Rules refer to “Donr Lottery” (“the Lottery”) and are subject to change from time to time. Each Entrant will join the Lottery on behalf of a chosen charity, with their chosen charity receiving 51% of their entry fee.
Each Entrant should retain a copy of these Rules for their reference. If Entrants do not agree to comply with these various Rules, Policies or Procedures they should not enter the Lottery.
1.1 The Lottery is being promoted by and on behalf of Charities Trust (“the Society”), incorporated and registered in England and Wales with company number 02142757, whose registered address is at Suite 22 Century Building, Tower Street, Brunswick Business Park, Liverpool, L3 4BJ. The persons responsible are Euan Imrie and Peter Hayes on behalf of Charities Trust (“the Promoter”) under Remote Large Society Lottery Licence Number 000-006068-R-104648 issued by the Gambling Commission.
1.2 Designated Beneficiary Charities shall receive proceeds of a total of 51% of the entry fee from entries made on their behalf.
1.3 The Lottery is managed externally by Capen Limited (“Capen”), a company registered in England and Wales with company number 08141955 and whose registered address is c/o Wem & Co, Savoy House, Savoy Circus, London, W3 7DA. Capen is licensed by the Gambling Commission to promote and operate the Lottery in accordance with the provisions of the Gambling Act 2005 as an external Lottery manager with licence number (Type F, Remote) (000-036257-R-317724-008).
1.4 Donr (company number 10402410) whose registered address is at The Stables, St George’s Terrace, Newcastle upon Tyne, NE2 2SU will operate as the Trusted Payment Intermediary (the “Tier 1 Mobile Aggregator”), offering a mobile payments service, working with each of the UK Mobile Network Operators (MNOs). This enables receipt of payments for goods and services, in this case, Society Lotteries. Donr will also act as the Marketing Services Provider of the society lottery (the “Service Provider”). This role includes working with partners to advertise the society lottery. Donr will also be responsible for the settlement of the prize pool to End Customers of the lottery under the direction of the Society.
1.5 The Society reserves the right to suspend, cancel or amend the Lottery or these Rules at any time without prior notice. Any such changes will be posted on the Website before they take effect.
1.6 The Lottery is a weekly society lottery in which prizes can be won by Entrants who have purchased Tickets. The determination of prizes is described in Section 5.
2.1 All Entrants must register their details on the Website in order to purchase Tickets in the Lottery. Entrants must be resident in the United Kingdom and confirm they are over 18 during the registration process.
2.2 To participate in the Lottery, Entrants must be aged 18 (eighteen) or over. Any Entrant found to be under 18 years of age at the time of participation in the Lottery automatically forfeits the right to any Prize and will have the associated Ticket price refunded. We conduct random checks of entrants to ensure there are no underage entrants. Age verification and identity checks, including through Age Checked or any other credit agency, may be carried out to verify the age of Entrants at registration or from time to time.
2.3 Directors or employees of Capen, or any members of the Society who are directly responsible for managing the Lottery, are ineligible to participate in the Lottery.
2.4 The eligibility of any Entrant is at the sole discretion of the Society, which reserves the right to disqualify or decline to accept participation by any Entrant if it has reasonable grounds to believe the Entrant has breached any of these Rules or otherwise acted fraudulently. Ineligible Entrants will not be entitled to receive a Prize, and any Prize awarded to an ineligible Entrant may be revoked (if not previously paid) or reclaimed from the Entrant (if already received).
3.1 The Draw process is based upon the results of the first six digits of Germany’s Spiel 77 lottery which is drawn every Saturday at 18:45 CET and the results are published on the website (http://www.lotterypost.com/game/326). The Winning Number for each weekly draw shall be the first six digits (in the same order) of that week’s Germany’s Spiel 77 lottery.
3.2 In order to comply with the 2005 Gambling Act only those Chances for which payment has been received are eligible for entry into the Draw.
3.3 In the event that the German Spiel 77 lottery as described in Rule 3.1 does not occur or is declared void on a single occasion then the Winning Number shall be determined in the same way but from an alternative lottery game. Details of such an occurrence will be published on the Lottery website.
3.4 In the event that the Draw process in Rule 3.1 ceases to occur or is subject to fundamental change which prevents a Winning Number being selected the Society reserves the right to select an alternative Draw process. Such an alternative Draw process would be selected on the basis that the basic principles of the Draw as described in Rule 3.1 would continue and the basic principles of how winners would be selected would continue as described in Rule 5. Such changes will be published on the Lottery website.
3.5 The Society, beneficiary charities, Capen and Donr are not related in any way to Germany’s Spiel 77 lottery or any other organisation involved in the operation of the Spiel 77 lottery.
3.6 The approximate winning probabilities are summarised below:
(a) Six Number Match 1 in 1,000,000
(b) Five Number Match 1 in 55,556
(c) Four Number Match 1 in 5,556
(d) Three Number Match 1 in 556
4.1 The Lottery is held each week
4.2 A six digit Game Number will be issued to entrants via SMS. The six digit Game Number is unique to each individual chance purchased, and is yours for as long as you continue to play.
4.2 The price of a Ticket is £2 and purchases are only possible through the Website. Each completed Ticket purchase will be recorded electronically by Capen using Licensed Remote Gambling Software and will be visible to the Entrant through the Website. A unique six-digit number will be allocated for each Ticket purchased and this number will be sent electronically to the Entrant prior to the Draw in accordance with Rule 4.9.
4.3 Tickets can be purchased by carrier billing, with the entrants mobile account being charged for the ticket purchase.
4.4 No Entrant may purchase more than 10 Tickets for a Draw.
4.5 All Ticket sales are final and subject to Clause 3.2. Refunds will only be processed at the request of the Society. No refunds will be made for Draws that have been completed.
4.6 Only tickets for which full payment has been received are eligible for entry.
4.7 Payments for Tickets by carrier billing will be debited on the day the Entrant completes the purchase on the Website. If Entrants select to continuously recur the Ticket purchase, on a weekly, monthly, quarterly or other frequency, payment will be taken in accordance with the frequency selected based on the date the Entrant completed their original Ticket purchase on the Website, unless canceled by the Entrant using the STOP function in accordance with Rule 7.3.
4.8 Tickets purchased before the Friday of each week at 17:00 shall be included in the Draw held on the following Saturday and the six-digit number associated with the Ticket will be confirmed electronically as per Rule 4.2. The Society shall have overall discretion to determine whether the purchase of a Ticket has occurred in accordance with these Rules, including with Rule 3.2, and is consequently eligible for participation in the Draw.
4.9 The Society and its partners cannot be held responsible, and will not accept liability, for incomplete purchases (caused by corruption of data transmission or otherwise) and these shall not be eligible for participation in the Draw.
4.10 Entrants acknowledge that purchase of a Ticket to participate in the Lottery does not guarantee that they will win any Prize.
5.1. Prize winners will be determined by whether an entrant’s Game Number relating to an entry in the Lottery matches all or some of the Winning Number as described in Rule 3.1 and dependent that the entry relating to your ticket number in question complies with Rule 3.2.
Six number match
(a) If all six digits of your ticket number match the Winning Number in the same positions then this is a “6 Number Match”
(i) If your ticket number is 123456 and the Winning Number is 123456 this is a “6 number match”
Five number match
(b) If five digits of your ticket number match the first or last five digits of the Winning Number and their positions in your ticket number match their positions in the Winning Number then this is a “5 Number Match”
(i) If your ticket number is 123456 and the Winning Number is 123452 this is a “5 number match” as the first five digits match
(ii) If your ticket number is 123456 and the Winning Number is 523456 this is a “5 number match” as the last five digits match
Four number match
(c) If four digits of your ticket number match the first or last four digits of the Winning Number and their positions match then this is a “4 Number Match”
(i) If your ticket number is 123456 and the Winning Number is 123465 this is a “4 number match” as the first four digits match
(ii) If your ticket number is 123456 and the Winning Number is 213456 this is a “4 number match” as the last four digits match
Three number match
(d) If three digits of your ticket number match the first or last three digits of the Winning Number and their positions match then this is a “3 Number Match”
(i) If your ticket number is 123456 and the Winning Number is 123654 this is a “3 number match” as the first three digits match
(ii) If your ticket number is 123456 and the Winning Number is 321456 this is a “3 number match” as the final three digits match
5.2. Prizes are issued as follows
(a) For a 6 Number Match, the prize will be £10,000 to the entrant
(b) For a 5 Number Match, the prize will be £1,000
(c) For a 4 Number Match, the prize will be £100
(d) For a 3 Number Match, the prize will be £10
5.3. Each ticket number shall only be entitled to win one prize in one Draw. The prize won will relate to the highest Number Match to which your ticket number matches.
5.4. The results of each Draw will be published on the Website.
5.5. The names of prize winners may be announced on the Website.
5.6. Prize winners will be notified by text or phone (using the details held by the Society or, if different, the details supplied by the entrant in his or her entry) within 28 days of the relevant draw date.
5.7. The Society reserves the right to amend the prizes at any time. Any such changes will be published on the Website, at least one month prior to a change being made.
5.8. Winners of a prize will receive their prize through one of the following means, at the discretion of the Society:
(a) by credit transfer to mobile phone used to enter lottery
(b) Post Office payout
(d) by any other payment means that may become available to the participating Society
5.9. We will make all reasonable efforts to identify and contact winners, however, if a prize winner fails (for whatever reason) to claim their Prize within 30 days of receipt of the Society’s notification, the ticket will expire and the Prize will be forfeited.
5.10. The results of the Draw will be published on the Website.
5.11. The names of prize winners may be announced on the Website at the Society’s sole discretion.
5.12 The winner may need to provide proof of age before collecting the prize. Acceptable documentation of the winner’s proof of age will be a scan of their passport or driving licence.
6.1. Additional bonus prizes (cash or otherwise) may from time to time be available to win subject to “Draw Specific Rules” that will be published from time to time (in advance) on the Website.
7.1 Responsible Play. Entrants are encouraged to participate in the Lottery sensibly. Please read the Social Responsibility Guidelines, which can be found on the Website. Our social responsibility policies cover our commitment to a fair and open draws policy and contain the procedures relating to Entrants’ queries and complaints. The Society and its agents are committed to relevant guidelines for responsible gambling and associated procedures.
7.2 Liability. The Society cannot accept any liability (other than for death or personal injury or other liabilities that cannot, as a matter of law, be excluded) for any damage, loss, costs, expenses or disappointment, whether direct or indirect, caused to or suffered by Entrants in connection with this Lottery or as a result of Entrants’ accepting or making use of any Prize. In particular, all Entrants are solely responsible for providing and (where necessary) updating the Society with their accurate and up-to-date contact details and the Society will be in no way liable for any failure or inability to contact any Entrant due to any errors, omissions or inaccuracies in the contact details that the Entrant has provided.
7.3 Cancellations. To cancel your mobile subscription, text STOP to 89365, or an alternative number as advertised from time to time. Texts are charged at your standard network rate. Entrant refunds will only be facilitated at the request of the Society. No refunds will be made for draws that have been completed. Refunds are the sole responsibility of the Society.
7.5 Disputes. In the event of any dispute regarding the Lottery, if the dispute cannot be resolved by the parties within 90 days, it will be referred to the Independent Betting Adjudication Service Limited, an independent third party. For further information please refer to the Complaints Policy, which can be found on the Website.
7.6 Law. These Rules and any non-contractual obligations connected to them shall be governed by and construed in accordance with the laws of England and Wales and, failing satisfactory resolution of any dispute in accordance with Rule 7.5, the UK courts shall have exclusive jurisdiction to settle any dispute which may arise under or in connection with them.
7.7 Severance. If any provision of these Rules is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of those terms, which shall remain in full force and effect.
7.8 Charity Proceeds. 51% of the entry cost will be transferred to the designated beneficiary charity by the Society within 28 days of receipt of funds.
