Lottery Rules

These Rules (“Rules”) refer to the “Donr Lottery” (“the Lottery”) and are subject to change from time to time.
 
These Rules, together with any specific terms or conditions as relevant to the Lottery (whether displayed in promotional materials or otherwise) apply to all participants in the Lottery. By entering the Lottery, you (“Entrant”) agree to be bound by these Rules, the privacy policy and, where applicable, the social responsibility guidelines, each of which can be found at legal.donr.com.
 
Each Entrant should retain a copy of these Rules for their reference. If an Entrant does not agree to comply with these rules, policies, or procedures then they should not enter the Lottery. 

1. Introduction

1.1 The Lottery is managed by ImpulsePay Ltd, registered in England and Wales, company number 04395570. Our registered address is The Stables, St Georges Terrace, Newcastle, NE2 2HB.
 
1.2 ImpulsePay Ltd is registered as an External Lottery Manager (“ELM”) with the Gambling Commission under Remote Operating Licence Number 058029-R-333796-001 and account number 58029. The designated responsible persons are Christopher Newell and Paul Paterson.
 
1.3 A designated beneficiary society or charity (“Society”) of this Lottery shall receive proceeds amounting to a minimum of 51% of the payment for entry tickets (“Ticket”), as paid for by the Entrant. The beneficiary Society shall be identified to the Entrant during entry into the Lottery.
 
1.4 The ELM reserves the right to suspend, cancel or amend the Lottery or these Rules at any time, without prior notice by posting an updated set of Rules to legal.donr.com, which will take effect 28 days after being published.
 
1.5 The Lottery is a weekly society lottery in which prizes can be won by Entrants who have purchased Tickets. The determination of prizes (“Prize”) is described in clause 9.

2. Eligibility

2.1 All Entrants must register to purchase Ticket(s) in the Lottery, through lottery.donr.com (“the Website”). Entrants must be resident in Great Britain to participate in the Lottery.
 
2.2 To participate in the Lottery, Entrants must be aged 18 (eighteen) or over. Any Entrant found to be under 18 years of age at the time of participation in the Lottery automatically forfeits the right to any Prize and will have the associated entry fee refunded.
 
2.3 The ELM may conduct random checks of entrants to ensure there are no underage entrants. Age verification and identity checks, including through a credit agency, may be carried out to verify the age of Entrants at registration; in the event of a winning Ticket or from time to time as the ELM, at its sole discretion, deems necessary.
 
2.4 Directors or employees of the ELM, or any members of the Society who are directly responsible for managing the Lottery, are ineligible to participate in the Lottery.
 
2.5 The eligibility of any Entrant is at the sole discretion of the ELM, which reserves the right to disqualify or decline to accept participation by any Entrant if it has reasonable grounds to believe the Entrant has breached any of these Rules or otherwise acted fraudulently. Ineligible Entrants will not be entitled to receive a Prize, and any Prize awarded to an ineligible Entrant may be revoked (if not previously paid) or reclaimed from the Entrant (if already received).

3. Tickets

3.1 A Ticket constitutes an entry into a single week of the Lottery Draw. 
 
3.2 A six-digit number will be issued to the Entrant when they purchase a Ticket.

3.3 This Ticket may only have one six-digit number associated with it, which is unique to the individual Ticket and cannot be changed.

3.4 The six-digit number issued to the Entrant may be refreshed for each weekly draw. In these circumstances the Entrant will be issued a new six-digit number for each Ticket, which will be available to view on help.donr.com.
 
3.5 The price of a Ticket is £2 and purchases are only possible through the Website. Each completed Ticket purchase will be recorded electronically by the ELM and issued prior to the Draw and in accordance with clause 3.9.
 
3.6 An Entrant may purchase a maximum of 5 Tickets for a Draw.
 
3.7 All Ticket sales are final and subject to clause 3.8. Refunds will only be processed at the request of the Society. No refunds will be made for Draws that have been completed.
 
3.8 Only Ticket(s) for which payment has been made are eligible for entry, in order to comply with the 2005 Gambling Act.

3.9 Tickets purchased before 23:59:59 on the Friday of each week shall be included in the Draw held on the following Saturday. The ELM shall have sole discretion to determine whether the purchase of a Ticket has occurred in accordance with these Rules and has met the timeframe specified for participation in the Draw.

3.10 The ELM and its partners cannot be held responsible, and will not accept liability, for incomplete purchases (caused by corruption of data or otherwise) and these shall not be eligible for participation in the Draw.
 
3.11 Entrants acknowledge that purchase of a Ticket to participate in the Lottery does not guarantee that they will win any Prize.
 
3.12 Information (including personal information) recorded for the purposes of operating the Lottery will, unless specifically stated otherwise, be used by the ELM in accordance with the privacy policy. By entering the Lottery, Entrant’s consent to the use of their name in connection with clause 9.9.

4. Payment

4.1 Payment for Ticket(s) can be made using one of the following methods:

1. Carrier billing, which charges the cost to the Entrants mobile phone account.

2. Standing order

3. Direct Debit

4.2 The first Ticket will be issued once payment has been made by your chosen payment method and will be entered into the next available draw.

4.3 For the avoidance of doubt, time is not of the essence when entering the first draw and Ticket(s) purchased close to the cut off time outlined in clause 3.9 may be delayed to the following week’s Draw at the sole discretion of the ELM.

4.4 For subsequent draws purchased using carrier billing, the Entrant will be debited on a weekly or a monthly basis. The ELM may convert a weekly debit to a monthly debit with 28 days notice and provide you with the opportunity to remain on a weekly debit if you do not wish to change.

4.5 For subsequent draws purchased using Direct Debit, the Entrant will be debited on a monthly basis.

4.6 For subsequent draws purchased using standing order, the Entrant will be debited on a monthly basis.

4.7 Any surplus funds for future Draws are held securely by the ELM as customer funds and converted to lottery proceeds when Ticket(s) are issued for the appropriate Draw.

4.8 Should payment not be received, the ELM will pause the entry into the Lottery for a period of time, during which time no Tickets will be issued for the Entrant.

4.9 The length of time an entry remains paused for is at the sole discretion of the ELM.

4.10 If no payment is received during the time in which an entry is paused, the entry into the Lottery will be cancelled.

4.11 Payment will continue to be debited for Tickets, unless entry is cancelled by the Entrant in accordance with clause 11.3.

4.12 In the event of surplus funds being accumulated, for example due to the timing of monthly payments, the ELM will issue additional Ticket(s) should the surplus amount exceed the cost of a Ticket(s). 

4.13 The ELM will make reasonable efforts to reconcile all payments with the relevant Lottery Entrant. In cases where it is not possible to reconcile a payment, for example, due to missing or incomplete information, then the funds will be donated to a charity of the ELM’s choice.

4.14 If the ELM, Society or other party is prevented from operating the Lottery then payment for Ticket(s) may be converted to a donation to the Society, at the sole discretion of the ELM. Should this occur, the Entrant will be notified and given the instructions to cancel their support if sufficient time is available.

5. Protection of Customer Funds

5.1 The ELM stores customer funds in a separate client account for the Societies we act for. These funds are transferred to the Society on a regular basis, in accordance with our contractual agreement with the Society.

6. Lottery Draw

6.1 The Lottery Draw takes place on a weekly basis on a Saturday and the Bonus Draw will take place after this.

6.2 For Lotteries taking place before 4th August 2023, there is one Jackpot Draw. Each Ticket will constitute one entry into the Jackpot Draw.

6.3. For Lotteries taking place from 5th August 2023 onwards, there is one Jackpot Draw and one Bonus Draw. Each Ticket will constitute one entry into the Jackpot Draw and one entry into the Bonus Draw.

7. The Jackpot Draw

7.1 The Jackpot Draw is based upon the results of the first six digits of the Germany Spiel 77 lottery which is drawn every Saturday and the results are published on various websites, including http://www.lotterypost.com/game/326.
 
7.2 The winning number (“Winning Number”) shall be the first six digits (in the same order) of that week’s Lottery Draw.
 
7.3 If the German Spiel 77 lottery as described in clause 7.1 does not occur or is declared void on a single occasion then the Winning Number shall be determined in the same way but from an alternative lottery game. Details of such an occurrence will be published on legal.donr.com.
 
7.4. If the Lottery Draw process in clause 7.1 ceases to occur or is subject to fundamental change which prevent a Winning Number from being selected then the ELM may select an alternative Lottery Draw process. Such an alternative would apply the same principles of the Lottery Draw, as described in clause 7.1 and winners would be selected as per clauses 9.2 and 9.3. Such changes will be published at legal.donr.com.
 
7.5. The ELM and the Society are not related to the Germany Spiel 77 lottery, or any other organisation involved in the operation of the Spiel 77 lottery.

7.6. The approximate winning probability for draws taking place before 4th August 2023 is:
- for a Six Number Match 1 in 1,000,000
- for a Five number match, 1 in 18,518
- for a Four number match, 1 in 823
- for a Three number match, 1 in 69

7.7. The approximate winning probability for draws taking place from 5th August 2023 onwards is:
- for a Six Number Match 1 in 1,000,000
- for a Two number match, 1 in 11

8. Bonus Draw

8.1 The Bonus Draw process is based upon the random generation of a winner from the Tickets in the Bonus Draw. The winner(s) will be drawn at random using the online resource http://www.random.org/ who are independently verified for their random number generation using atmospheric noise.

8.2 In the event that the online resource http://www.random.org/ as described in clause 8.1 is not available on a single occasion then the winner shall be determined in the same way but from an alternative random number generating resource. Details of such an occurrence will be published on the Lottery website.

8.3 In the event that the online resource http://www.random.org/ as described in clause 8.1 ceases to be available or is subject to fundamental change which prevents a winning ticket being selected then the ELM reserves the right to select an alternative Random number generating process. Such an alternative process would be selected on the basis that the basic principles of the Draw as described in clause 8.1 would continue and the basic principles of how winners would be selected would continue as described in clauses 9.4, 9.5 and 9.6. Such changes will be published on the Lottery website.

8.4 The ELM and the Society are not related in any way to Random.org

9. Prizes

9.1 Prize winners for the Jackpot Draw will be determined by whether an Entrant’s six-digit Ticket number matches all or some of the Winning Numbers described in clauses 7.1 and 7.2.

Six number match

If all six numbers of a Ticket match the Winning Number in the same position, then this is a “6 Number Match”. For example, if a Ticket is 123456 and the Winning Number is 123456 then this is a 6 Number Match.

Five number match

If five numbers of a Ticket match the Winning Number in the same position, then this is a “5 Number Match”. For example, if a Ticket is 120456 and the Winning Number is 123456 then this is a 5 Number Match as 5 numbers match the winning number in the same sequence.

Four number match

If four numbers of a Ticket match the Winning Number in the same position, then this is a “4 Number Match”. For example, if a Ticket is 120406 and the Winning Number is 123456 then this is a 4 Number Match as 4 numbers match the winning number in the same sequence.

Three number match

If three numbers of a Ticket match the Winning Number in the same position, then this is a “3 Number Match”. For example, if a Ticket is 100406 and the Winning Number is 123456 then this is a 3 Number Match as 3 numbers match the winning number in the same sequence.

Two number match

If two numbers of a Ticket match the Winning Number in the same position, then this is a “2 Number Match”. For example, if a Ticket is 100006 and the Winning Number is 123456 then this is a 2 Number Match as 2 numbers match the winning number in the same sequence.

9.2 For Lotteries taking place before 4th August 2023, the prize structure for the Jackpot Draw will be as follows:

For a 6 Number Match, the Prize is £10,000; for a 5 Number match the prize is £1,000; for a 4 Number match the prize is £10 and for a 3 Number match the prize is 5 entries into the next Draw.

9.3 For Lotteries taking place on or after 5th August 2023, the prize structure for the Jackpot Draw will be as follows:

For a 6 Number Match, the Prize is £10,000; for a 2 Number match the prize is 5 additional entries into the Bonus Draw for the following week.

9.4 Prize winners for the Bonus Draw will be determined by whether their Ticket number is selected at random, as described in clause 8.1.

9.5 The first Ticket selected in the Bonus Draw will win the Top Bonus Prize of £500.

9.6 The subsequent five Tickets selected in the Bonus Draw will each win a Runners Up Bonus Prize of £100.

9.7 Each Ticket shall only be entitled to win one Prize per Ticket and the highest value prize will take precedence.

9.8 The results of each Draw will be published on help.donr.com.

9.9 The names of prize winners may be announced on help.donr.com, legal.donr.com or the Website.

9.10 Prize winners will be notified by text or phone (using the details held by the ELM) within 28 days of the relevant draw date.

9.11 The ELM reserves the right to amend the prizes at any time. Any such changes will be published on legal.donr.com, at least 28 days prior to a change being made.

9.12 Winners of a Prize will receive their Prize through one of the following means, at the discretion of the ELM:

(a) BACS

(b) by any other payment means that may become available to the participating Society

9.13 We will make all reasonable efforts to identify and contact winners, however, if a Prize winner fails (for whatever reason) to claim their Prize within 30 days of receipt of the ELM’s notification, the Prize will be forfeited.

9.14 The winner may need to provide proof of age before collecting the Prize. Acceptable documentation of the winner’s proof of age will be a scan of their passport or driving licence, along with confirmation they match the document identity via a video call or similar process. Alternative age verification technology may be used at the sole discretion of the ELM.

9.15 Any cash Prize will usually be paid within 90 days of the Draw and the Entrant accepts that time is not of the essence and that no payment will be made before our checks are complete.

9.16 From time to time, additional Prizes may be offered by the Society for Entrants into a Draw(s). These Prizes do not form part of the Prizes listed in clauses 9.2, 9.3, 9.5 or 9.6 and are entirely offered by the Society on a goodwill basis. No combination of Prize(s) will exceed £25,000.

10. Self-Exclusion

10.1 Should an entrant feel that they have issues with gambling and wish to be self-excluded from our Lottery please phone our helpline on 03334444111 or email help@donr.com.
 
10.2 There is a minimum self-exclusion period of 6 months and this will remain enforced until we are satisfied that any risk or harm associated with gambling or otherwise has been overcome by the Entrant.
 
10.3 During self-exclusion, all accounts associated with the Entrant will be closed and any funds held will be returned to the Entrant. We will also seek to block any targeted marketing as soon as is practically possible.

11. General

11.1 Responsible Play. Entrants are encouraged to participate in the Lottery sensibly. Please read the Social Responsibility Guidelines, which can be found on legal.donr.com. Our social responsibility policies cover our commitment to a fair process and contain the procedures relating to queries and complaints.
 
11.2 Liability. The ELM or Society cannot accept any liability (other than for death or personal injury or other liabilities that cannot, as a matter of law, be excluded) for any damage, loss, costs, expenses or disappointment, whether direct or indirect, caused to or suffered by Entrants in connection with this Lottery or as a result of Entrants’ accepting or making use of any Prize. All Entrants are solely responsible for providing and (where necessary) updating the ELM with their accurate and up-to-date contact details and the ELM will be in no way liable for any failure or inability to contact any Entrant due to any errors, omissions or inaccuracies in the contact details that the Entrant has provided.
 
11.3 Cancellations. You may cancel your entry by visiting help.donr.com and following the instructions to cancel your entry. Alternatively, you can contact the ELM via 03334444111 or help@donr.com to cancel your entry.

11.5 Disputes. In the event of any dispute regarding the Lottery, if the dispute cannot be resolved by the parties within 90 days, it will be referred to the Independent Betting Adjudication Service Limited, an independent third party.
 
11.6 Law. These Rules and any non-contractual obligations connected to them shall be governed by and construed in accordance with the laws of England and Wales and failing satisfactory resolution of any dispute in accordance with clause 11.5, the UK courts shall have exclusive jurisdiction to settle any dispute which may arise under or in connection with them.
 
11.7 Severance. If any provision of these Rules is found to be invalid by any court having competent jurisdiction, the invalidity of that provision will not affect the validity of the remaining provisions of those terms, which shall remain in full force and effect.

11.8. Closure or suspension. If the Lottery is closed, suspended, prevented from running or is unable to operate for any reason, then any payments for Tickets will be paid to the Society as a donation. The donation amount will be net of any administrative charges agreed between the ELM and Society. In these circumstances, the ELM will communicate with all Entrants to inform them that the Lottery is not taking place and provide instructions for cancelling Entries.
